ABC, Just Say No to Smart & Final's Petition to Modify Conditions at Store 389

After up to a decade or more of exercising clearly unfair competition in our neighborhoods, Smart & Final is requesting the California Department of Alcoholic Beverage Control modify the Conditional License for the location on W. 19th Street known as Store 389.

Please help your Westside neighbors and sign our petition to ask the California Department of Alcoholic Beverage Control to Just Say NO to the Smart & Final petition.

In their Petition to Modify Conditions presented to the ABC, Smart & Final cites their weakened ability to compete, now that they must operate within the law. In light of their unlawful operations over the last decasde and the negative impacts on the community, their claims are farcical.

Residential neighbors of the grocery chain's 'Store 389' have opposed their 'Petition to Modify Conditions' for over six months. During this period, residents are experiencing pressure from the ABC to drop their opposition to the Petition.

Smart & Final does not have grounds to be granted their Petition request. Business and Professions Code - BPC § 23803 states: The department, upon its own motion or upon the petition of a licensee or a transferee who has filed an application for the transfer of the license, if it is satisfied that the grounds which caused the imposition of the conditions no longer exist, shall order their removal or modification, provided written notice is given to the local governing body of the area in which the premises are located.
NONE of the facts that triggered the imposition of conditions have changed.
Please consider the long-term damage Smart & Final did to our community along W 19th Street. For a decade or longer, they bootlegged beer, wine, and liquor in the community. They don't have a weakened ability to compete at all! Their unlawful practices severely weakened numerous mom & pop markets in our neighborhood. Since 2012, they have gained tremendous grocery market share and now have the upper hand.
